一、行政处罚案件名称及文书号 卢**房屋违法违规建筑案，(元)城罚决字[2022]第4号。 二、被处罚当事人基本情况 姓名：卢**，性别:男，民族：哈尼，身份证号：5325281979********，住址或住所：元阳县新街镇。 三、主要违法事实 经调查核实、查看相关资料，房屋已建盖5层，房屋建盖已完工。该宗地土地使用证（元国用（2016）第003号）使用面积为240.01平方米，产权人为卢江城。建设工程规划许可证（建字第元阳县202100015号）建筑面积为985平方米，根据自然资源局及第三方测绘公司出具的不动产测量报告：该宗地占地面积为240.01平方米，建筑面积为1033.86平方米。超出规划许可建筑面积为48.86平方米，属违法违规超建建筑。 四、证据 证据一：土地使用证（元国用[2016]第003号）;证明：土地使用面积为240.01平方米。证据二：建设工规划许可证（建字第元阳县202100015号）；证明：规划建筑面积为985平方米。证据三：不动产测量报告；证明：建筑面积为1033.86平方米。证据四：调查（询问）笔录；证明：承认违法违规建筑面积为48.86平方米。 五、行政处罚依据 依据《云南省违法建筑处置规定》第九条规定：城镇违法建筑由违法建筑处置部门责令停止建设；尚可采取改正措施消除对规划实施的影响（以下简称消除影响）的，限期改正，并处建设工程造价5%以上10%以下的罚款；无法采取改正措施消除影响的，限期拆除。 六、行政处罚结果 我局对当事人违法行为作出《行政处罚决定书》（（元）城罚决字[2022]第4号），处罚建设工程造价5%的罚款.（100.00元/平方米，合4886.00元，人民币肆仟捌佰捌拾陆元整）。请在接到本处罚决定之日起15日内缴至指定银行账号里。逾期不缴纳罚款的，我局将根据《中华人民共和国行政处罚法》第七十二条第（一）项。“每日按罚款数额的3％加处罚款”的规定执行。 如你（单位）不服本处罚决定，可以根据《中华人民共和国行政复议法》，在收到本决定之日起60日内向元阳县人民政府申请行政复议，或根据《中华人民共和国行政诉讼法》，在6个月内向元阳县人民法院提起行政诉讼。行政复议和行政诉讼期间，本处罚决定不停止执行。 元阳县住房和城乡建设局 2022年3月18日
